Terms and Conditions

Scope of Services

We provide app development, maintenance, and deployment services. This includes, but is not limited to, writing code, designing UI/UX, and managing the submission process to the Google Play Store on behalf of the Client.

Work Steps

To publish the app on the Play Store, the Client agrees to the following workflow:

  • Internal Testing: The Client must submit the app for internal testing. Our expert team will review the app and provide feedback. If approved, we will proceed to production review.
  • App Review: Our team manages the review process and provides necessary updates and screenshots.

Client Responsibilities & Google Compliance

To ensure alignment with Google Play Console policies and avoid account association risks:

  • Account Ownership (Recommended): We strongly recommend that Clients provide their own Google Play Developer Account. This ensures you retain full ownership and avoids risks associated with shared "Agency" accounts.
  • Content Policy: The Client warrants that the app content does not violate Google’s Developer Program Policies (e.g., no hate speech, illegal activities, or deceptive behavior).
  • Policy Strikes: We are not liable if Google rejects, suspends, or bans an app due to the Client's specific content requests or business model.

Payment Policy

All payments are non-refundable. Once a payment is made, it is final. Payments must be timely; otherwise, we reserve the right to terminate the project.

Mandatory Compliance & Termination Policy

We reserve the right to terminate any project immediately if the Client violates these terms, fails to provide necessary information, or requests features that breach Google Play policies. In such cases, all payments are non-refundable.

  • Continuous Monitoring: We monitor apps for policy compliance. If an app is suspended or removed due to policy violations, we will notify the client. We do not charge additional fees for standard remediation validation.
  • Strict Prohibitions: We do not manage applications involving real-money gambling, casinos, high-risk financial services, or spyware.
  • Immediate Action: If an application is found to contain illegal activities, hidden gambling/casino modules, spyware, or malicious code after deployment, we will delete the application and terminate the partnership immediately.

Intellectual Property (IP)

  • Client IP: The Client retains ownership of all pre-existing trademarks, logos, and specific business logic provided to us.
  • Developer Tooling: We retain ownership of any proprietary "boilerplate" code, libraries, or internal tools used to build the app that existed prior to this agreement.

Deployment & Store Approval

While we follow industry best practices for deployment:

  • No Guarantee of Acceptance: Google Play’s review process is subjective. We do not guarantee that Google will approve the app for publication.
  • Rejection Handling: If an app is rejected due to a coding error on our part, we will provide one round of fixes at no extra cost. Rejections due to "Policy Violations" related to the Client's business model are subject to additional consulting fees.

Data Privacy & Security

Both parties agree to comply with global data protection laws (GDPR, CCPA, etc.).

  • The Client is the Data Controller.
  • We act as the Data Processor during the development phase.
  • The Client must provide a valid Privacy Policy URL for the Google Play Store listing.

Managed Technical Services

Once a project is approved, BDMADE operates as your technical partner:

  • Release Management: We handle technical signing, submission, and lifecycle management.
  • Operational Security: Console operations are managed by our technical team to maintain environment security.
  • LiveOps Support: Includes monitoring of Android vitals and crash reporting (ANRs).
  • QA Support: Includes closed testing and open testing management.

Console Access & Management

Option A: Client-Owned Account (Highly Recommended) The Client invites BDMADE as a "Release Manager". The Client retains full legal ownership and Admin control of the Google Play Console.
Option B: BDMADE Managed Account (Fallback) If the Client does not have a Developer Account, we may deploy the app under our central agency account. In this scenario:
  • No Direct Access: The Client will not receive login credentials for our Console to protect other clients' data.
  • Listing Control: BDMADE retains administrative control over the store listing.
  • Transferability: We will transfer the app to a Client's account in the future upon request, provided all invoices are paid. However, if the Client violates these Terms & Conditions, the right to transfer is immediately revoked.

Limitation of Liability

In no event shall we be liable for any indirect, incidental, or consequential damages, including loss of profits or "loss of service" resulting from an app being removed from the Google Play Store by Google.

Amendments & Updates

BDMADE reserves the full right to update, modify, or change these Terms and Conditions at any time without prior notice or consent. Continued cooperation implies acceptance of the revised terms.
